I’m Separated – Now What?

Written by Pearsons Lawyers

For most, the end of a romantic relationship is traumatic and confusing. If you are the one not ending the relationship then you can be caught unaware and “on the back foot”.  Even for a party making the decision to terminate a relationship, there can be significant uncertainty, disruption and a sense of loss of direction and control.

When your relationship has come to an end the question is – “now what?”  What steps do you need to take to protect yourself, your children or your property?

Obviously, each and every case is different and the advice about what options you have differ from case to case.  Fortunately, the specialist and expert legal team at Pearsons Family Lawyers are ready, willing and able to guide you and shed some light on what options are available to you, the possible consequences and what steps, if any, you should take.

Pearsons Family Lawyers offers the first initial consultation free of charge.  At the end of the free initial consultation, you will have a much better idea about the steps that need to be taken.

It may be that there is nothing for you to do but sit tight.  Sometimes the best thing to do is nothing – at least for now.

At other times, immediate action may be necessary.  For example:-

  1. Lodging a Caveat over property that you have an interest in to protect your interest;
  2. Freezing bank accounts or investments;
  3. Obtaining urgent restraining orders to protect property;
  4. Making an Application for an Intervention Order to protect yourself and/or children;
  5. Defending an Intervention Order made against you;
  6. Obtaining sole and exclusive use and enjoyment of the family home;
  7. Obtaining an order recovering children who have been removed without your permission from their home/school/community;
  8. Applying for urgent interim spousal maintenance; and
  9. Making an application to Services Australia for an administrative assessment of child support.

Divorce and separation are difficult.  The team of Family Lawyers at Pearsons Family Lawyers can advise and guide you to ensure that you are aware of your rights and entitlements and take the necessary steps from the very outset to ensure that the outcomes are as positive and beneficial for you and your children as possible.
