What do I need to get a divorce?
To get a divorce, you must file an Application for Divorce with the Family Court and pay a filing fee. Once the Application is filed, it must be served on the other party. If the Court is satisfied that the parties have been separated for 12 months and all other matters have been appropriately dealt with, a Divorce Order will be granted.
The process is relatively straightforward and inexpensive, but it is important to seek legal advice to protect your rights.

How much will it cost me to get a divorce?
Filing for a divorce is relatively inexpensive, with costs typically starting at around $1,000 unless you are eligible for a reduced concession fee. However, additional charges will vary depending on the complexity of the case – which may relate to overseas marriages or difficulties locating original paperwork. Pearsons Lawyers can discuss costs during your free consultation and provide regular updates so there are no surprises.

How do we decide on parenting arrangements?
After a separation, it is common for parents to disagree about the living arrangements, supervision, and care of their children. This can be a very difficult and stressful time for everyone involved. Parents can seek separate legal advice and work with Pearsons Lawyers to negotiate a parenting agreement.
We can also help parents engage a mediator or mediation service to facilitate discussions about parenting matters. If an agreement can be reached through lawyers, our family law specialists can formalise the parenting plan into court orders.
How does property settlement work?
Usually, couples can agree on property settlement through negotiations, mediation, or the courts. Mediation may be an option if negotiations cannot achieve an agreement. Mediation is a process where a neutral third party helps the couple reach an agreement. If mediation is unsuccessful, the couple may need to go to Court. The Court will hear evidence from both parties and decide how the property should be divided.
