In Victoria, applicants must meet certain criteria to be eligible to adopt. They must be at least 18 years old, and typically, there is an age gap requirement, with the adoptive parent being at least 18 years older than the child being adopted.

Applicants must be Australian citizens or permanent residents and must live in Victoria. Both couples (whether married or in a de facto relationship) and single individuals are eligible to apply.

Additionally, applicants need to be in good physical and mental health, demonstrating their ability to provide a stable, supportive environment for the child. Those with serious criminal convictions, especially those involving harm to children, are ineligible for adoption.

These guidelines are set out in the Adoption Act 1984 (Vic), with each adoption application assessed individually to determine what is in the best interests of the child.

What official agencies will we work with during the adoption process?

You will work with agencies such as Human Services, the Federal Circuit, and the Family Court to navigate adoption procedures, including placement and application processes.

Which court are adoption orders made in?

Adoption orders are made in the Federal Circuit and Family Court. Parenting orders may also be sought from this court to establish care arrangements post-adoption.

What happens to a child’s birth certificate after adoption?

After adoption, the child’s birth certificate is amended to reflect the new adoptive parents. It will show the adoptive parents as the child’s legal parents, with the birth parents’ details removed.

Can we choose for our adopted child to stay in touch with their biological parents?

In certain cases, if exceptional circumstances exist, the court may allow contact with biological parents. A step-parent adoption or agreement may also specify ongoing contact arrangements.

Can I adopt a foster child?

Yes, you can adopt a foster child if they have been in your care for an extended period and adoption is deemed in their best interests. Legal proceedings involve the Federal Circuit and Family Court.
