Starting the Divorce Process
You can file for divorce 12 months after separating from your partner. Either party can initiate the process, and you may apply individually or jointly. Typically, your ex-partner cannot contest the divorce, except in certain circumstances. If your marriage lasted less than two years, a counselling certificate is required.
If you and your partner continued to live under the same roof after separating, you can still apply for a divorce. However, you’ll need to provide witness evidence showing that you lived separately within the home. This includes demonstrating that you slept in different rooms, did not perform household duties for each other, kept separate finances, did not socialise together, and were publicly recognised as separated.
